Cast Network understands that your privacy is very important to you and that is why Cast Network is the sole owner of any information that is collected from the Cast Network Service. Safeguarding the privacy of our ("Users", "you" or "your") is the pledge and duty of Cast Network via the services offered to you by the Cast Network Service ("us" or "we"). The purpose of this Privacy Policy is to provide you information about the governing regulations and policies surrounding any collection, use and disclosure of any information you may provide to Cast Network.
By utilizing the Cast Network Service, you agree to all terms and conditions of this Privacy Policy. This Privacy Policy is incorporated into, and is subject to, the Cast Network Terms of Use. This Privacy Policy applies to all websites and services provided via the Cast Network Service and in connection with the Cast Network Service to include, but not limited to, Cast Network affiliates. This Privacy Policy does not apply to other third party services available from or by Cast Network, or to third party advertisers ("Third Party Services"). We will not sell, share or rent collected information to anyone in any way other than that expressly disclosed in this Privacy Policy. This Privacy Policy may be updated periodically and notifications to such updates or material changes will be accomplished by posting the amended Privacy Policy on the Cast Network Web Site at www.castnetwork.com/privacy-policy. (The Privacy Policy will be posted with the most recent date of update.)
Information Collection
Cast Network Service collects the following information:
Personally Identifiable Information or ("Personal Information") is information that you may provide us during the course of the utilization of our service or participation in a sponsored contest, to include but not limited to; your name, personal and/or business phone numbers, credit card or other billing information, email addresses and home and/or business addresses. Personal Information that is collected is primarily used for the purpose of providing our service to you and communication with you.
Non-Identifying Information is information that you submit through the participation of our service by way of your Cast Network Service registration (creating an Account), creation and administration of your Cast
Network Profile Web Page, creation and administration of your Cast Network Channel Web page(s); to include, with limitation to, your city, state, zip code, individual preferences and clues to other personal information by way of compilation of the forgoing, along with any other text, audio, video or images (collectively "Member Content"). This information may be used to provide a better quality service to you and to assist us in determining our services use and priorities.
Statistical Information is information that is collected by any User of the Cast Network Service to include registered Members an visitors. The Cast Network Service will record information to include, but not limited to, your computer's IP address, browser used, referring domain, duration of use, viewed Member Content and dates and times of participation. This information may be used to provide a better quality service for you and to assist us in determining our services use and priorities.
Cookies are small data files that we send to your computer. We use Cookies in two separate ways (Persistent
and Session). Persistent Cookies hold your registration ID and/or password for future login to the Cast Network Service on subsequent visits and remain until you delete them from your web browser. Session Cookies enable certain functionality of the Cast Network Service and cease to exist once you've closed your browser. (You may not be able to utilize all areas of the Cast Network service if you do not accept cookies.) This information may be used to provide a better quality service for you and to assist us in determining our services use and priorities.
A Web Beacon, also called a Web bug, pixel tag or a clear GIF, is used in combination with cookies. A Web beacon is an often-transparent graphic image, usually no larger than 1 pixel x 1 pixel, that we may place in
websites or e-mail associated with the Cast Network Service. Web Beacons work in conjunction with cookies, registering when your computer visits a particular web page associated with the Cast Network Service. If you turn off cookies and do not accept them the pixel tag will simply detect an anonymous visit. This information may be used to provide a better quality service for you and to assist us in determining our services use and priorities.
Information Usage
Cast Network will use information that we collect or that you provide for the purposes of providing, maintaining, improving and tracking the Cast Network Service.
Cast Network will, without liability and prior notice to you, use any available information about you for the purpose of communication with you about the following; to include, but not limited to, Cast Network Service maintenance, support, billing, security or changes in policies.
Cast Network will use information received by the Cast Network Service to improve our service, functionality and our growth.
Cast Network will use Statistical Information, Cookies and Web Beacons, without limitation to; monitor traffic and web pages accessed, track promotions, determine popular features, categories or services, avoid the necessity of subsequent log-ins, monitor advertising and marketing campaigns and review demographics and patterns.
Sharing and Disclosing Information
Cast Network will not purposefully make available, distribute, sell or rent any of your personal information to others except to allow services or products you have requested or when we have your permission to do so. However, if you make available any personal information that you display in public areas of the Cast Network Service you understand and acknowledge that such information may be collected and used by others.
Cast Network may disclose any information other than Personal Information with third parties to allow for comprehension of usage, patterns and reports associated with content, services, contests and promotions,
functionality, advertising and trending factors associated with the Cast Network Service. Such disclosed information may be aggregated or niche specific and may be disclosed, in whole or in part, at the sole discretion of Cast Network.
Cast Network, at our sole discretion, will disclose any and all information about you to governmental entities, law enforcement officials, private parties and collection agencies we believe necessary and right to
include, but not limited to, a response to claims, subpoenas, warrants, court orders, the protection of Cast Network's property, rights and licenses, an associated third party's rights, safety and/or security of any person or the general public and the prevention of any crime or ethically immoral activity. Furthermore, Cast Network, at our sole discretion, will disclose any and all information about you that we believe is appropriate and right to include, but not limited to; protection against liability, adherence to our Terms of Use,
defense against third-party claims or to protect Cast Network Users.
Cast Network may make available, without formally disclosing, any or all of your information without limitation to the following third-party service providers that pertain to the following services contracted by Cast Network; database superintendents, maintenance, analytic specialists, technical engineers, webmasters and programmers. Such contracted third-party service representatives are constrained to the disclosure of any information due to their accessibility to such information by Cast Network. In the event that anyone mishandles or misuses any of your information, by fault or no fault of Cast Network, you hereby agree to hold Cast Network harmless and without liability for such actions or any result of such actions.
Cast Network may, at our sole discretion and without limitation, convey all or part of your information, without benefit to you, in association with a merger, acquisition, sale, bankruptcy or a business reorganization involving Cast Network.
Personal Information Options and Access
It is your sole decision and option to submit, or decline to submit, your Personal Information to Cast Network. Should you choose not to submit your personal information with Cast Network, you will be unable to
participate in many of the available featured services we offer. If you decide to submit your personal information with Cast Network, you may access, update, correct or delete your information by e-mailing us at support@castnetwork.com.
Advertisers
Cast Network allows advertisers (Third-Party Ad Servers) to serve advertisements within the Cast Network Service. Such Third-Party Ad Servers may serve their Cast Network advertisements straight to your browser and
collect your IP (Internet Protocol) address along with other data simultaneously. Furthermore, these Third-Party Ad Servers may also include other information gathering technologies to include, without imitation; Cookies, Web Beacons, and scripts or programs to analyze the performance of their advertising
placement. Cast Network will not give your personal information to Advertiser or Third-Party Ad Servers without your permission. Advertisers and Third-Party Ad Servers have their own Privacy Policies and we cannot and do not supervise, endorse, support or control their information collection actions, techniques or methods. Therefore, this Privacy Policy does not apply to such Advertisers or
Third-Party Ad Servers. Cast Network at our sole discretion reserves the
right to add or remove participating Advertisers or Third-Party Ad Servers
without liability.
Information Security
Cast Network uses commercially reasonable efforts to protect our Users' Personal Information and only allows those working for, or on behalf of, Cast Network that absolutely require access to such Personal Information, the authority to do so. We cannot guarantee 100% security due to forces or conditions beyond our control and will not warrant your information's security. In the event of a security violation or breach, Cast Network may attempt to contact you.
Children's Privacy
Cast Network considers Child Safety to be extremely important and will not knowingly collect Personal Information from any child under the age of 13. Parents or guardians of children under the age of 13 that discover that the child is participating with the Cast Network Service and/or has submitted Personal Information should contact Cast Network immediately so that the child's information may be deleted.
International Users
There are various jurisdictional privacy laws and protective covenants that govern Personal Information collection, distribution, storage and use. Cast Network operates globally and by you submitting any information to Cast Network you hereby expressly consent to the transfer of such information to the United States or other countries.
Declaration of Agreement
Your use of the Cast Network Service is your declaration of agreement to this Privacy Policy and all future revisions thereof.
